Orry Caught in Controversy: Booked for Consuming Alcohol Near Vaishno Devi

Social media influencer Orhan Awatramani, famously known as Orry, has found himself in legal trouble along with seven others. The police have booked the group for allegedly consuming alcohol at a hotel in Katra, the base camp for the revered Vaishno Devi shrine. The incident has sparked outrage online, with netizens demanding a ban on Orry for disrespecting Hindu sentiments.

The Case Explained

On March 15, the Katra Police received a complaint stating that hotel guests were consuming alcohol and non-vegetarian food, which goes against the area’s religious customs. Following the complaint, the police registered an FIR under Section 223 of the Bharatiya Nyaya Sanhita (BNS) and assigned a special team to investigate and take action against the individuals involved.

What Does the Law Say?

Section 223 of the BNS deals with disobeying orders issued by a public servant. Last month, Katra Sub-Divisional Magistrate Piyush Dhotra passed an order under Section 163 of the BNS, strictly prohibiting the sale, possession, and consumption of liquor and non-vegetarian food in the area to uphold religious sentiments.

If found guilty, the accused may face:

  • If their actions caused annoyance or obstruction, they could be sentenced to up to six months in jail, a fine of 2,500, or both.
  • If the violation endangered human life, health, or public safety, the penalty could be up to one year in jail, a fine of 5,000, or both.

The law does not require proof of intent to harm; simply violating the order is enough to warrant legal action.

Should Orry be Punished?

The focus should be on the facts and the legal framework in place. The law exists to maintain order, and if an individual, whether a celebrity or a commoner, violates it, the consequences should be the same for all. In this case, if the prohibition on alcohol and non-vegetarian food near Vaishno Devi was officially enforced, the law must take its course, irrespective of status or influence. Selective enforcement only fuels public distrust. Justice should be uniform; rules apply to everyone or are reconsidered altogether.
